Claims Commission eFILE - Terms of Service


By using the e-FILE system available on this website, you agree to the following:

1.     You are solely responsible for uploading and transmitting documents correctly and in a timely fashion and for checking and responding to notifications, email or otherwise, for rejected filings or documents. If a Registered User elects to use the e-FILE system for a particular claim, all accepted filings made through the e-FILE system are deemed filed with the Commission. However, you are still responsible for serving the document on the individual Commissioner.

2.     In order to serve parties through the e-FILE system, you must enter Additional Registered Users (i.e., all attorneys representing a party in the claim who are Registered Users of the e-FILE system and any self-represented party who is a Registered User of the e-FILE system) according to the instructions on the upload pages. In the instance that a party is not a Registered User, you remain responsible for proper service on that party through the conventional means of service. Please do not contact the Claims Commissioners or the Clerk’s Office to determine whether a party or a party’s attorney is a Registered User. It is your responsibility to contact all attorneys representing a party and any self-represented parties to determine if they are Registers Users.

3.     You acknowledge that e-filing is a convenience service and that you must make alternative arrangements to file any necessary documents in the event e-filing is unavailable or malfunctioning. You acknowledge that timely filing and serving of motions, briefs and other documents in compliance with applicable law and regulations is the responsibility of the party or that party’s attorney, if applicable.

4.     You are solely responsible for your information. In connection with e-filing, you will not: (a) post, submit or otherwise do anything with respect to e-filing that is unlawful, harmful, tortious, defamatory, profane, obscene, libelous, hateful or offensive to the average user; (b) violate or infringe upon the proprietary or other rights of any individual or third party; (c) violate any applicable rules or orders of any court or the Claims Commission; (d) use E-filing for the electronic filing or serving of any documents not permitted by the rules of the Claims Commission; or (e) defeat or attempt to defeat the security of the system or in any way access information in a way that is outside of the Website's intended operation as defined within the applicable user documentation. You are responsible for following all Claims Commission rules, including those pertaining to the inclusion of personal or sensitive information, including, but not limited to, Social Security numbers, financial account numbers and proprietary information, in documents filed with the Claims Commission. 5.     You may not use the e-filing service or any portion of this website for any illegal purpose or in any manner inconsistent with this Agreement. Any such activity or use is an "Unauthorized Use". An Unauthorized Use also includes, but is not limited to, performing, or carrying out, any of the prohibited acts set out in this Section. You may not decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivative works from this website or the e-filing service, nor may you use any network monitoring or discovery software to determine the site architecture, or extract information about usage or users. You may not use any robot, spider, other automatic device, or manual process to monitor or copy this website or the e-filing service. You may not copy, modify, reproduce, download, republish, distribute, display, or transmit for commercial, non-profit or public purposes all or any portion of this website or the e-filing service, except to the extent permitted in this Agreement. You may not upload to this website any data, material, code, virus, or any other digital information that is intended to, or has the effect of, rendering all or parts of this website or the e-filing service ineffective, unavailable, or unusable, or which uses, or attempts to use, this website or the e-filing service for any purpose not intended by the State of Tennessee. You may not use or otherwise export or re-export this website or any portion thereof, or the content or any software available on or through the website, in violation of the export control laws and regulations of the United States of America or any other country in which you may be using the website. You will not alter or remove any trademark, copyright or other notice from any copies of the content. You may not sublicense, assign, sell or transfer this license. Any Unauthorized Use of the website or the e-filing service is prohibited. Your violation of any of the foregoing provisions constitutes Unauthorized Use, and may result in civil or criminal liability.
